שמירה על סודיות הנתונים ופרטיות המשתמש 

9.1. מסירת הפרטים האישיים בטופס ההזמנה (להלן: "המידע") נעשית עפ"י רצונו של הלקוח ובהסכמתו. מילוי הפרטים מעיד על הסכמת הלקוח למסירתם. מטרת מסירת הפרטים האישיים היא לאפשר לחברה לספק את ההזמנה ללקוח. 

9.2. בית העסק מתחייב שלא לעשות כל שימוש במידע ללא הרשאת הלקוח אלא אם כן הדבר נדרש או מותר עפ"י דין או כדי למנוע שימוש לרעה במידע. בית העסק יאפשר גישה למידע רק לעובדיו הזקוקים למידע לצורך מתן שירות ולחברת ההפצה. 

9.3. כל העברה של מספר כרטיס אשראי מהאתר נעשית באופן מוצפן לפי תקןPCI . בית העסק משתמש במערכת PCI לצורך סליקת כרטיסי אשראי. בית העסק עושה כל שביכולתו ונעזר באמצעי אבטחה טכנולוגיים וארגוניים מתקדמים כדי לאבטח את האתר, את התקשורת דרכו ואת המידע המצוי בשליטתו, כנגד ניצול מקרי או מכוון, אובדן, הרס או כנגד גישה על ידי אנשים בלתי מוסמכים או מורשים. ההתקשרות בין המחשב של המשתמש או המבקר באתר לבין מחשבי העסק מאובטחת באמצעות שיטות הצפנה מקובלות, בהתאם לתקנים הנהוגים. כמו כן, בית העסק נוקט באמצעים סבירים להגנה על האתר ועל רכיבי חומרה ותוכנה הקשורים בתפעולו ודואגת לעדכנם באופן שוטף, בין היתר, כדי להגן על האתר ועל תוכנו מפני חדירות, פרצות או האזנות בלתי מורשות. 

9.4. יתכן שבעת גלישה או ביצוע פעולות באתר, יתועדו פעולות המשתמש באופן אוטומטי וממוחשב, פרטים אלו משמשים את בית העסק לצרכי בקרה והתייעלות ניהולית ושיווקית מול משתמשי האתר. 

9.5. יתכן וחלק מהשירותים באתר טעונים הרשמה. במסגרת תהליך ההרשמה ידרש הלקוח לבחור שם משתמש וסיסמא שיזהו את הלקוח בעת השימוש. בית העסק רשאי לקבוע מעת לעת דרכי זיהוי נוספות או אחרות. על הלקוח לשמור על שם המשתמש והסיסמא בסודיות כדי למנוע שימוש לרעה בהם. 

9.6. המידע והפרטים שייאספו לגבי הלקוח במהלך השימוש באתר, יישמרו במאגר המידע של בית העסק. השימוש באתר על ידי המשתמש ואישורו של המשתמש למדיניות הפרטיות של בית העסק מעידים על כך כי המשתמש מסכים שפרטיו יישמרו וינוהלו במאגר המידע של בית העסק. המידע שבמאגר ישמש – בהתאם להוראות מדיניות פרטיות זו או על פי הוראות כל דין – למטרות המפורטות להלן: 

9.6.1. כדי לאפשר ללקוח לבצע הזמנות באתר. 

9.6.2. כדי לזהות את הלקוח במהלך כניסות חוזרות לאתר. 

9.6.3. כדי לשפר ולהעשיר את השירותים והתכנים המוצעים באתר, ובכלל זה ליצור שירותים ותכנים חדשים המתאימים לדרישות המשתמשים באתר וציפיותיהם ולשנות או לבטל שירותים ותכנים קיימים. המידע שישמש את בית העסק לצורך כך יהיה בעיקרו מידע סטטיסטי, שאינו מזהה את הלקוח באופן אישי; 

9.6.4. כדי לאפשר למשתמשים להתאים את השירותים באתר להעדפותיהם; 

9.6.5. כדי לאפשר לבית העסק ליצור קשר עם הלקוח ולשלוח אליו מדי פעם בדואר אלקטרוני מידע בדבר שירותיה ומוצריה של בית העסק, סקרים ושאלונים, כמו גם מידע פרסומי ומידע בקשר עם מוצרים ושירותים של אחרים. מידע כזה ישוגר אל הלקוח בהתאם להסכמה מפורשת שנתן הלקוח לכך במהלך ההרשמה באתר או בכל עת אחרת. הלקוח יכול לבטל את הסכמתו בכל עת ולחדול מקבלת פניות וחומר פרסומי מהנהלת האתר. 

9.6.6. מובהר כי הסכמה למדיניות פרטיות זו מהווה הסכמה לצורך הוראות סעיף 30א לחוק התקשורת (בזק ושירותים), התשמ"ב-1982; 

9.6.7. ליצירת הקשר עם הלקוח במידת הצורך; 

9.6.8. לצורך ניתוח, בקרה ומסירת מידע סטטיסטי לצדדים שלישיים. מידע זה לא יזהה את הלקוח באופן אישי; 

9.6.9. לכל מטרה אחרת, המפורטת במדיניות פרטיות זו או בתנאי השימוש והרכישה של האתר. 

9.7. בית העסק לא יעביר לצדדים שלישיים את פרטי הלקוחות האישיים והמידע שנאסף על פעילותם באתר אלא במקרים שלהלן: 

9.7.1. ככל שהדבר דרוש לצורך אספקה תקינה של שירותי האתר ולצורך מימוש מטרות השימוש במידע כמפורט לעיל, ככל שנדרש הדבר; 

9.7.2. אם הלקוח הפר את תנאי השימוש והרכישה באתר, או אם הלקוח יבצע באמצעות האתר, או בקשר איתו, פעולות הנחזות כמנוגדות לדין או ניסיון לבצע פעולות כאלה; 

9.7.3. אם יתקבל בידי בית העסק צו שיפוטי או דרישה מרשות מוסמכת המורה לה למסור את פרטי הלקוח או את המידע אודותיו לצד שלישי; למען הסר כל ספק בית העסק אינו מתחייב להתנגד לשום בקשה לצו שיפוטי או דרישת רשות מוסמכת, שיחייב אותו למסור פרטים אודות הלקוח לצד שלישי. 

9.7.4. בכל מחלוקת, טענה, תביעה, דרישה או הליכים משפטיים, אם יהיו, בין הלקוח לבין בית העסק. 

9.7.5. בית העסק יהיה רשאי להעביר את פרטי הלקוח והמידע שנאסף בעקבות השימוש שעשה הלקוח באתר לחברות או לארגונים אחרים הקשורים לבית העסק, כדוגמת חברת-אם, חברה-בת וחברה אחות ובלבד שהם ישתמשו במידע זה רק על-פי הוראות מדיניות פרטיות זו; 

9.8. בית העסק רשאי למסור ולשתף מידע אנונימי, מצרפי וסטטיסטי עם חברות או ארגונים אחרים הקשורים בבית העסק וכן עם ספקים, שותפים עסקיים, מפרסמים וכל צד שלישי בהתאם לשיקול דעתו הבלעדי והמוחלט, אך בית העסק לא ייחשוף בפניהם ביודעין, או במכוון את זהות הלקוחות ללא הסכמתם המפורשת. 

9.9. בית העסק עושה שימוש בכלים כגון Remarketing, AdWords, Google Analytics ו PPC לצורך פרסום, איסוף נתונים ושיפור חווית המשתמש של הלקוח. בין השאר, בית העסק מקבל שירותים מחברות Facebook ו- Google לצורך הצגת מודעות של החברה ברשת האינטרנט. החברה רשאית להשתמש, בין בעצמה ובין באמצעות צדדים שלישיים כגון Google ו/או Facebook בקבצי 'עוגיות (Cookies) 'לצורך תפעולו השוטף והתקין של האתר ובכלל זה כדי לאסוף נתונים סטטיסטיים אודות השימוש באתר, לאימות פרטים, כדי להתאים את האתר להעדפות אישיות של הלקוח ולצרכי אבטחת מידע. 'עוגיות' הן קבצי טקסט, שהדפדפן במחשבו של הלקוח יוצר לפי פקודה ממחשבי בית העסק. חלק מהעוגיות יפקעו כאשר הלקוח יסגור את הדפדפן ואחרות נשמרות על גבי הכונן הקשיח במחשב שלו. העוגיות מכילות מידע מגוון כדוגמת הדפים שבהם ביקר הלקוח, משך הזמן ששהה הלקוח באתר, מהיכן הגיע הלקוח אל האתר, מדורים ומידע שהלקוח מבקש לראות בעת הכניסה לאתר ועוד. הם משמשות גם כדי לייתר את הצורך בהזנת פרטי הלקוח בכל פעם שהוא מבקר מחדש במדורים באתר המחייבים רישום, ככל שישנם כאלה. המידע בעוגיות מוצפן ובית העסק נוקט צעדי זהירות כדי להבטיח שרק מחשבי בית העסק יוכלו לקרוא ולהבין את המידע האגור בהם. הלקוח רשאי לבטל את הסכמתך לשימוש של ספקי צד שלישי כגון Google ו- Facebook על ידי ביקור בדף ההצטרפות של יוזמת הפרסום ברשת בכתובת: 

http://www.networkadvertising.org/choices/ 9.10. לקוח שאינו מעוניין שעוגיות יאספו במחשבו האישי, יכול להימנע מכך על ידי שינוי ההגדרות בדפדפן במחשבו. לשם כך נא היוועץ בקובץ העזרה של הדפדפן. יש לזכור שביטול העוגיות עלול לגרום לכך שחלק מהשירותים והתכונות באתר או באתרי אינטרנט אחרים לא יהיו זמינים. בנוסף לכך, ניתן למחוק את העוגיות במחשב בכל רגע. 

9.11. בית העסק רשאי להתיר לחברות צד-שלישי או לכל גורם אחר, לפרסם באתר ו/או לנהל את מערך הגשת הפרסומות באתר. 

9.12. בית העסק מיישם באתר מערכות שנועדו לאבטח את המידע באופן מיטבי, בהתאם לסטנדרטים מקובלים. בעוד שמערכות אלה מצמצמות את הסיכונים לחדירה בלתי-מורשית למחשבי בית העסק, אין בהן בטחון מוחלט. לכן, בית העסק לא מתחייב שהשירותים באתר יהיו חסינים באופן מוחלט מפני גישה בלתי-מורשית למידע המאוחסן בהם. 

9.13. על-פי חוק הגנת הפרטיות, התשמ"א – 1981- כל אדם זכאי לעיין בעצמו, או על ידי בא-כוחו שהוסמך כדין בכתב או על ידי אפוטרופוס, במידע שעליו מוחזק במאגר מידע. אדם שעיין במידע שעליו ומצא שאינו נכון, שלם, ברור או מעודכן, רשאי לפנות לבעל מאגר המידע בבקשה לתקן את המידע או למוחקו. אם בעל המאגר סירב, עליו להודיע על כך למבקש באופן ובדרך שנקבעו בתקנות. על סירובו של בעל מאגר מידע לאפשר עיון ועל הודעת סירוב לתקן או למחוק מידע, רשאי מבקש המידע לערער באופן ובדרך שנקבעו בתקנות.
